Council Extends Interim Urgency Ordinance on Marijuana

The Sausalito City Council voted on October 30 to extend the City's interim urgency marijuana ordinance through November 24, 2019. The interim urgency ordinance was originally passed in November 2017 and extended for the first time in January 2018. Without specific local regulations in place as of January 1, 2018, commercial marijuana businesses would have been allowed in Sausalito without any local regulation.

According to the interim urgency ordinance now in effect in Sausalito:
  • Delivery of medical and recreational marijuana into Sausalito is allowed
  • Other commercial activity such as retail sales, dispensaries, and distribution centers are prohibited
  • All businesses conducting cannabis-related deliveries into Sausalito must register or notify the City
  • Indoor cultivation for personal use is restricted to six or fewer adult plants
  • Outdoor marijuana cultivation is prohibited
The extension of the urgency ordinance gives the City Council additional time to consider permanent marijuana regulations. Among the modifications discussed by the Council on October 30 was the possibility of allowing commercial marijuana operations like manufacturing facilities and non-storefront retail operations. A local ballot measure such as San Rafael's Measure G would need to pass in order to tax marijuana businesses beyond Sausalito's existing business license and sales taxes.
