City Council to Discuss Short-Term Rentals at January 8 Meeting

The Sausalito City Council will continue its discussion of short-term rentals at its meeting on Tuesday, January 8, 2019. Under consideration will be whether to initiate a zoning ordinance amendment for a pilot program allowing short-term rentals. A short-term rental is defined as the rental of a home, dwelling unit, or room or rooms in a dwelling unit for a period of less than thirty days. Short-term rentals are currently prohibited in Sausalito.

The draft zoning ordinance amendment establishing a short-term rental pilot program includes the following provisions:
  • The pilot program will have a duration of one year
  • The number of short-term rental permits issued by the City will be capped at 100
  • The rental host must be the primary, long-term resident of the unit
  • The number of "unhosted" days a unit may be occupied as a short-term rental is limited to 90 days in a calendar year (an unhosted stay is when the primary resident is not present at the unit during the stay)
  • There is no limit on the number of hosted stays in a calendar year (a hosted stay is when a portion of a primary residence is occupied by a short-term renter when the primary resident is present)
  • A 24/7 hotline will be available for residents to report complaints about short-term rental properties
City staff has asked the Council to provide guidance on the following elements of the pilot program under consideration, among others:
  • Confirm the maximum number of permits to be allowed under the pilot program: proposed is 100
  • Confirm the maximum number of days for unhosted stays: proposed is 90 in a calendar year
  • Confirm that there is no maximum for hosted stays
  • Identify the method of issuing City permits to short-term renters (e.g. lottery or first-come, first served)
  • Confirm the definition of a "primary resident": proposed is "someone who has been physically present for no less than 183 days in a calendar year at the primary residence, and a person may only have one primary residence"
  • Identify the documentation required for proof of primary residency: proposed includes, but is not limited to, documentation from income tax statements or a driver's license
  • Identify the documentation required for safety inspection compliance: proposed is a building inspection report completed by a certified third-party general contractor, building inspector, or home inspector
  • Discuss liability insurance requirements: recommended is in the amount of at least $1,000,000
  • Confirm that parking requirements should be discussed by the Planning Commission, with the intent to require parking for short-term rental units
  • Identify the requirements for the local contact person for unhosted stays (where the primary resident is not present): proposed is a person who resides in Sausalito who is available 24 hours per day, 7 days per week during the term of any unhosted stay, and must respond within 30 minutes of being contacted
For a complete overview of the zoning ordinance amendment under consideration, please read the staff report to the City Council. If the Council decides to move forward with a zoning ordinance amendment, one noticed hearing by the Planning Commission and two noticed hearings by the Council must be held before it can be enacted. 

The January 8 meeting of the City Council will begin at 7:00 p.m. in the City Hall Council Chambers. The short-term rentals item is scheduled to begin at approximately 7:55 p.m. Time will be available for public comment.
