Tent Encampment Update, February 22, 2021

On Tuesday, February 23, U.S. District Court Judge Edward M. Chen will consider an application seeking a temporary restraining order to stop the City of Sausalito from relocating the occupants of the Dunphy Park encampment to Marinship Park. The City has opposed the application. The hearing, which is scheduled for 1:30 p.m., will be conducted via Zoom webinar. The court provides webinar access via this link: www.cand.uscourts.gov/emc

Sausalito officials today continued their outreach to local and regional partners in an effort to identify alternate and appropriate housing solutions for the occupants of the encampment. 

The application to halt the City from requiring individuals to leave Dunphy Park was filed on February 16 by the Sausalito/Marin chapter of the California Homeless Union – on behalf of itself and 10 individuals. The application names as defendants the City of Sausalito, Mayor Jill James Hoffman, Police Chief John Rohrbacher, Interim City Manager Marcia Raines, and Department of Public Works Supervisor Kent Basso. 

The City’s opposition to the application was filed with the court on February 17. The California Homeless Union’s response to the City's filing was filed earlier today. 

On February 5, the City Council approved a resolution closing certain City property, excepting an area designated within Marinship Park, to camping and storage of personal property. On February 9, the City posted a Notice to Vacate at Dunphy Park informing the occupants that the area would be cleared and cleaned no earlier than February 16. The notice also identified Marinship Park as a temporary, transitional overnight camping area for individuals who have no option for sleeping indoors. 

Marinship Park offers 24/7 restroom facilities, trash pickup, secure storage lockers for personal belongings and, twice a week, mobile showers and information on available social services.
