Tent Encampment Hearing on May 14

U.S. District Court Judge Edward M. Chen will hold an evidentiary hearing at 1:30 p.m. on Friday, May 14 to hear details on the process used by the City of Sausalito to determine that the demolition of boats at the U.S. Army Corps of Engineers yard does not pose a health hazard to individuals in Marinship Park.

The judge set the evidentiary hearing to clarify facts regarding the collection of air samples during recent boat demolition operations at the Army Corps site. The City filed a motion on April 9 to modify Judge Chen's preliminary injunction to allow the Dunphy Park tent encampment to be moved to Marinship Park based on new facts, including that Marinship Park does not present toxic risks. The City retained an environmental consultant to collect and analyze air samples while abatement operations were in process at the Army Corps yard. The analysis concluded that the boat disposal operations do not expose Marinship Park to toxic airborne materials.

The local chapter of the California Homeless Union opposed the City's motion to modify and took issue with the collection of air samples.

The two-hour hearing on May 14 is intended to allow the City and the California Homeless Union to each provide their own expert and to cross examine on evidence and testimony. Information on how to view the hearing can be found on the judge's web site.

Legal proceedings regarding the Dunphy Park encampment were initiated in February when the local chapter of the California Homeless Union filed an application to stop the closing of the Dunphy Park tent encampment and the relocation of its occupants to Marinship Park, in accordance with a resolution approved by the City Council in early February.
