Peace Officer Personnel Records – SB 1421 and SB 16

Senate Bill 1421 took effect January 1, 2019. It amended Penal Code § 832.7 to make certain peace officer personnel records available to the public under the California Public Records Act. Senate Bill 16 expanded the categories of disclosable records effective January 1, 2022.

The following records are subject to public disclosure:

  1. Use of force incidents:
    • an officer discharging a firearm at a person
    • a use of force by an officer that results in death or great bodily injury
  2. Sustained findings of:
    • unreasonable or excessive force
    • failure to intervene when another officer uses clearly unreasonable or excessive force
    • sexual assault involving a member of the public
    • dishonesty directly related to the reporting, investigation, or prosecution of a crime, or to the reporting or investigation of misconduct by another officer
    • prejudice or discrimination against a person based on a protected characteristic
    • an unlawful arrest or unlawful search

Records are also disclosable when an officer resigned before an investigation into one of these categories was completed.

Before releasing records, the Department may redact personal information, the identities of witnesses and victims, confidential medical information, and information whose disclosure would endanger someone's safety, as permitted by law.
